Lynda Carr worked for St. Claire’s hospital in Baraboo, Wisconsin. On September 14, 2010, she was working as an endoscopy technician. During the course of assisting with an endoscopic procedure, Ms. Carr reinjured her lower back. The worker’s compensation carrier disputed her claim, opining that her injury was merely a manifestation of a pre-existing condition. Additionally, it disputed whether Ms. Carr reported her injury to her doctor because the doctor’s records failed to mention the injury. A hearing was held and the Administrative Law Judge found that Ms. Carr was in fact injured at work and, as such, she was awarded over $34,000 in worker’s compensation benefits and over $70,000 in medical expenses.
