Attorneys William Parsons and David Zoeller have reached a settlement on behalf of 384 Waltco, Inc. delivery drivers. On February 18, 2010, Chief Judge Crabb of the United States District Court for the Western District of Wisconsin granted preliminary approval of a class action settlement in DeSerre v. Walto, Inc., 3:09-cv-422 (W.D. Wis.). Notice of the settlement will be sent to each of the 384 members of the class of drivers who are part of the settlement, and each driver will have an opportunity to accept their settlement by returning a claim form. The Plaintiff’s complaint alleged that Waltco failed to pay its drivers overtime wages for hours worked over forty in a week, and misclassified them as exempt from overtime pay.
