Attorneys William Parsons and David Zoeller have reached a settlement on behalf of 137 W.H.I.I., LLC delivery drivers. W.H.I.I., LLC contracted with DHL to deliver packages. On May 13, 2010, the parties moved the United States District Court for the Western District of Wisconsin for an order granting preliminary approval of a class action settlement in Fritz v. WHII LLC, et al, 3:09-cv-086 (W.D. Wis.). Upon the Court’s approval of that motion, notice of the settlement will be sent to each of the 137 members of the class of drivers who are part of the settlement, and each driver will have an opportunity to accept their settlement by returning a claim form. The Plaintiff’s complaint alleged that W.H.I.I., LLC failed to pay its drivers overtime wages for hours worked over forty in a week, and misclassified them as exempt from overtime pay.
