Caitlin Madden has worked as an attorney in Hawks Quindel’s Madison, Wisconsin office since 2014, ensuring that workers are paid the wages they’ve earned, and protecting employees subjected to discrimination. Born and raised in Wisconsin, Attorney Madden is proud to be fighting for workers’ rights in a state that has been on the forefront of progress.

Wage & Hour Litigation

Attorney Madden practices wage and hour law, where she ensures employees receive the pay they’ve earned. Attorney Madden represents both individual workers, and groups of employees who are being treated unfairly under a common policy in class actions.

Attorney Madden has successfully argued two cases before the Seventh Circuit Court of Appeals. She argued Lewis v. Epic Systems in 2016, leading to the court’s ruling that employers cannot bar employees from joining together to bring legal claims. In 2018, she argued Goplin v. WeConnect, which allowed a class of employees whose arbitration agreements did not name their employer to proceed with their claims in court.

Attorney Madden believes workers find strength in numbers, and has represented numerous classes of Wisconsin employees seeking payment of the wages they’ve earned. These cases include representing workers subject to unlawful tip pools, off-the-clock work, and unpaid overtime cases.

In addition to her class action cases, Attorney Madden has represented numerous individual employees in state court, federal court, and arbitration. She represents workers who have been deprived of their earned commissions, workers misclassified as exempt from overtime wages, and unpaid off-the-clock work.

Employment Attorney

In addition to fighting wage theft, Attorney Madden represents employees who have been treated unfairly based on their age, disability, gender, race, religion, or other protected status. In 2016, she and co-counsel achieved a trial victory on behalf of a Madison sales executive who had been denied compensation equal to a male co-worker performing the same work.

Attorney Madden is experienced with a broad variety of employment issues, including severance negotiationsunpaid commissions, and non-compete agreements.

Attorney Madden is a member of the Wisconsin State Bar, and the Legal Association of Women. She serves on the State Bar’s Labour and Employment Section Board, and the board for the Western District Bar Association. She has been selected as a Rising Star every year since 2016.
