Hawks Quindel Wins Overtime Class Action Trial for KFC Managers
After yearslong litigation, Hawks Quindel recently secured a unanimous jury verdict on behalf of a class of KFC managers seeking unpaid overtime compensation. The KFC managers alleged that they were improperly classified as exempt from Wisconsin’s overtime pay laws because they spent the majority of their time performing work alongside their hourly crew members and had limited authority in managing their restaurants. After a five-day trial in which numerous witnesses testified, the jury deliberated for less than an hour before returning a verdict in favor of the restaurant managers. The jury’s verdict will allow the restaurant managers to recover overtime wages for their hours worked over forty in workweek despite being salaried employees. Named Plaintiff Courtney Harmon noted that she and the other restaurant managers “worked tirelessly to ensure their restaurants were open and welcoming to the public” and stated that the jury’s verdict “reaffirms that every worker deserves to be treated with dignity, fairness, and respect.” Hawks Quindel’s trial team for the case included attorneys Summer Murshid, Larry Johnson, Timothy Maynard, Connor Clegg, and Chris Donahoe.
