A Wisconsin Administrative Law Judge affirmed the Wisconsin Department of Workforce Development’s initial determination that a certified nursing assistant was entitled to unemployment benefits. The Appeal Tribunal held that the former St. Mary’s Care Center employee did not engage in misconduct when the C.N.A. attempted to clean a resident who had defecated himself, and the resident slid off the side of the bed. “In this case, the employee was discharged for the result of her attempts to help the residents,” the Appeal Tribunal stated.
